Clark KC and Susie Mountain, Partner at instructing firm Brodies LLP, will discuss the recently issued UKSC decision In the Petition of DM.
The decision of the Supreme Court in the Petition of DM issued on 9th September 2026 concerned an application under the Hague Convention for return of a child to the US. The case involved both parents and the 15 year old child. It also involved written submissions from three interveners, The International Academy of Family Lawyers, The International Centre for Family Law, Policy and Practice, and Reunite International Centre for Family law. The decision is of great importance on the matter of the UNCRC and the child’s views, and the issue of tolerability in terms of a grave risk defence under article 13(b) of the Convention. The decision will be of interest to all family lawyers as it touches upon, amongst other matters, the fundaments of the UNCRC and its reach.
This free event will be Chaired by Lisa Girdwood, Partner and Head of the Family Team at Brodies and will feature an in depth talk from Marie H Clark KC, lead counsel for the successful Respondent, followed by a talk from Susie Mountain from the perspective of the instructing solicitors, Brodies LLP. All aspects of the case and its significance for family law practitioners will be covered. The event will feature a Q&A session and will conclude with a drink’s reception and networking opportunity. The event will qualify for 2 hours of CPD.
