Arnot Commercial Law Group host successful launch CPD event and Drinks reception

We are delighted to announce the success of the inaugural Arnot Manderson Commercial Law Seminar. Held on 9th May in the beautiful surroundings of Edinburgh’s historic Scotsman Hotel.  An array of respected delegates from some of the top Commercial teams in Scotland listened a conversation between Professor Claudio Michelon and Fergus Whyte dealing with the experience of giving expert evidence on foreign law in a Scottish court.  We are very grateful to Professor Michelon from the University of Edinburgh, for his interesting and amusing insights.

Attendees then heard from Iain Mitchell KC who covered Statutory Interpretation – a Science or an Art, exploring the very different approaches taken by the Sheriff Court and Sheriff Appeal Court on the one hand, and the Inner House on the other in the recent case of King v Black Horse [2024] CSIH 3, to the interpretation of the Consumer Rights Act 2015 and whether we could ever see the day when statutes are interpreted algorithmically by Artificial Intelligence Systems.

The final speaker was Neil Morrison who gave a perspective on Loss of Chance Commercial Claims, discussing Duty of care, Burden of proof, Causation, Evaluation of loss of chance and a review of recent loss of chance case law including Centenary 6 Limited v TLT LLP.

The event closed with a drinks reception in the Fettercairn Garden Suite.
