Simon Crabb in Inner House success
Arnot Manderson member and Prisoners Rights specialist Simon Crabb, pictured recently appeared alongside senior counsel Fred Mackintosh QC in a successful appeal to the Extra Division of the Inner House against refusal to grant permission for a judicial review of a decision by the Parole Board.
The case of “Andrew Brown v The Parole Board for Scotland” was heard by Lord Woolman, Lord Malcolm and Lord Doherty and the full Judgement can be found here: 2021csih020518286a8898069d2b500ff0000d74aa7.pdf (scotcourts.gov.uk)
The Inner House set out important guidance about reviewing parole decisions: “under the modern context-specific approach to rationality and reasons challenges, in the area of detention and liberty the court must adopt an anxious scrutiny of the decision” (para. 36).
Arnot Manderson boasts a number of counsel with considerable experience of Prisoners Rights cases and the Clerking team would be happy to discuss with instructing solicitors how our members can be of assistance in this distinct area of law,
