Gail Hawthorne, a senior Junior Member of Arnot Manderson Advocates since 2005, was invited to present a talk at The Asian Aquacultural Insurance & Risk Management Conference in Hong Kong.
Aquaculture, also known as fish or shellfish farming, refers to the breeding, rearing, and harvesting of plants and animals in all types of water environments including ponds, rivers, lakes, and the ocean.
Aquaculture is an increasingly important industry, and in Scotland, it produces our most valuable export. The Scottish Government has identified the food and drinks sector as a key economic area for development.
This international conference gathered together a number of recognised world-wide experts to provide information and advice to those in the insurance sector involved in providing or extending their services within the rapidly expanding Asian aquaculture sector.
Gail’s talk covered key legal considerations and potential pitfalls for the aquaculture insurance and underwriting markets, highlighted relevant case law from a number of jurisdictions, and identified how legal spend could be managed, including careful choice of law terms, choice of forum for any disputes which may later arise, arbitration and remitting to person of skill.
