Practice Profile

Prior to calling to the Bar, David practised for several years as a solicitor in the top-ranked Commercial Litigation team at McGrigors. As a solicitor, David represented clients in all areas of commercial disputes. He advised in numerous actions in the Court of Session and Sheriff Courts, at arbitration and in the Lands Tribunal. David also appeared regularly in the Sheriff Courts, including at debate and proof. Since calling to the Bar, David has appeared in the Inner and Outer Houses of the Court of Session and in the Sheriff Courts.

In addition to his expertise in general contractual matters, David has significant experience in property litigation (including landlord and tenant), banking and credit, PFI and procurement disputes. David has assisted clients in a number of other specialist areas including: corporate governance, insolvency, insurance, judicial review, partnership, personal injury, planning, product liability, professional negligence, tax and trusts. As a solicitor, he advised clients from a number of specialist sectors, among them financial services, energy, infrastructure, construction and aviation.

    As a solicitor. Defending a claim for gambling losses allegedly caused by participation in a clinical drugs trial. Successfully establishing on the procedure roll that the defenders did not owe any obligation of compensation in terms of the clinical trial patient agreement

  • Mactaggart & Mickel Homes Ltd v Hunter & Hunter [2010] CSOH 130; 2010 GWD 33-683

    As a solicitor. Action seeking recovery of the value of £1.5M paid in terms of missives conditional upon planning permission. Successfully establishing at proof that the client had complied with its obligation to use reasonable endeavours to obtain planning permission

  • As a solicitor. Commercial: lead solicitor in a commercial action in the Court of Session for payment of sums due in terms of a multi-site commercial coffee supply and equipment rental agreement

  • As a solicitor. Commercial: lead solicitor in an arbitration and subsequent negotiation arising from a multi-site £1.2M facilities management agreement

  • As a solicitor. Procurement contracts: acting for a PFI service company in relation to multi-million pound breaches of a construction agreement for a waste water treatment facility and associated breaches by the service company of warranties under the operating agreement
