Speakers:

Laura Thomson – “Open justice and closed doors: A v BBC” Laura will discuss the UK Supreme Court’s judgment, and its potential reach.

Wojciech Jajdelski – “Time-bar in professional liability cases.”  Wojciech will review recent cases on prescription with particular relevance to professional negligence claims and will also discuss the role of seeking, and acting on, expert advice in the exercise of reasonable diligence for the purposes of section 11(3) of the 1973 Act; and the court’s approach to causation in cases where such advice is not sought or followed.

David Massaro – “A Matter of Interpretation – recent developments relating to commercial leases”  2014 has already seen a number of important cases concerning commercial leases.  In particular, there have been decisions of the Supreme Court, Inner House and Outer House relating to dilapidations, interpretation, consent, and break notices.  David’s talk will consider these recent cases and their implications, and will be of interest to practitioners who deal with property and contract disputes.

Scott Manson – “Penniless Rascals and the Wisdom of Solomon: Recent Trends in Adjudication Enforcement in the Commercial Court”  Scott will review three recent cases concerning attempts to block enforcement of adjudicator’s awards in the Court of Session relying on issues of insolvency, malfeasance and incoherence.
